Hershey, the renowned chocolate giant, recently emerged victorious in a class action lawsuit that accused the company of deceiving customers who purchased Halloween-themed Reese’s candy with expectations of the spooky designs showcased on the packaging. The federal judge presiding over the case granted Hershey’s motion to dismiss the complaint, citing that the customers did not suffer any tangible harm.
The lawsuit was filed in southern Florida last year, with the plaintiffs contending that they were misled by the packaging of pumpkin- and ghost-shaped candies that displayed intricate designs. Upon opening the products, they were disappointed to find the candies to be plain and unadorned.
In response, Hershey argued that the customers did not incur any financial loss as they still received the delicious Reese’s candy they paid for. The company pointed out that the packaging included images of the candies in their uncarved state, along with a disclaimer suggesting decoration for the artistic renderings.
The initial lawsuit sought damages of at least $5 million, but Hershey’s successful dismissal has put an end to that claim. Despite the ruling, Anthony Russo, the attorney representing the plaintiffs, emphasized that the court’s decision was procedural and not based on the merits of the case. He vowed to take further action to protect consumers and ensure transparent labeling practices.
Hershey, on the other hand, remains focused on delivering innovative products to consumers. This Halloween season, the company introduced new treats such as miniature Reese’s in collaboration with Peanuts’ “It’s the Great Pumpkin Charlie Brown,” vampire-shaped Kit Kats, and ghost-shaped Twizzlers.
Earlier this year, Hershey announced plans to raise candy prices due to the unprecedented cost of cocoa. Despite this, the company reported a 26% year-over-year increase in consolidated net sales, driven by early shipments of Halloween candy and consumer enthusiasm for “summer-ween.”
